What it means
Debt recovery escalates from reminders to a formal letter before action, then a court claim, then enforcement.
Why it matters
Most debts are recovered before court. The letter before action, properly written and referencing statutory interest, resolves a large share.
What it looks like in practice
Money Claim Online handles undisputed debts without a solicitor, with fees scaled to the amount and usually recoverable from the debtor.\n\nJudgment is not payment — enforcement is a separate step, and a judgment against a company with no assets is worth nothing.
What to watch out for
Statutory demands and winding-up petitions used as a collection tool where the debt is genuinely disputed. That is an abuse of process and can be costly.\n\nAnd the six-year limitation period, which is longer than people think and does eventually run out.
Where to get proper advice
Your solicitor for the letter before action. A debt collection agency for volume, on a commission basis.
