What it is
After an annual review meeting the council must decide, within four weeks, whether to maintain, amend or cease the plan, and tell you.
Where it applies
Everyone with an EHCP.
How it works
If it decides to amend, it must send the proposed amendments with the reasons, allow at least 15 days for comment, and issue the final amended plan within eight weeks of the amendment notice.
Each decision letter carries appeal rights, and the appeal clock runs from it. A review that produces no letter has not finished, and the right to appeal has not been triggered.
What you can ask for
Diarise four weeks from the meeting and chase in writing if nothing arrives.
Ask for the decision in writing with reasons and appeal rights. All three are required.
If the deadlines pass, that is maladministration and the Ombudsman route applies while any disagreement about content goes to the Tribunal.
